Remedies for breach

This module will look at what happens when there is a breach of contract and damages, which is the most common remedy claimants want when they have to start legal proceedings.

In this course we will begin with the case law precedent Hadley v Baxendale (1854). This case says what rights an injured (non-breaching) party has when they have suffered loss of income following a breach of contract. The case has been the basis for calculating damages for over 160 years, and is used by Courts in many common law countries.

At the end of this course, you will know more about:

  • the remedies available in the common law courts for breach of contract cases and the general legal terminology involved
  • equitable remedies such as specific performance and injunctions for a breach of contract
  • the duty of the injured party to mitigate a loss and come with clean hands when there is a breach of contract
  • the importance of the precedent case of Hadley v Baxendale (1854) in common law
  • the concepts of contractual direct loss and indirect loss
  • the requirement that a loss be reasonably foreseeable by the defendant to succeed
  • the case of Victoria Laundry v Newman Industries (1949) and how it confirmed the Hadley principle
  • a Court’s requirement for a schedule of loss and other evidence in litigation
  • some key legal English terms that are essential to practising commercial law at an international level

Preparing for the SQE: This module provides a solid basis for any international lawyer or law student who plans to sit the SQE. If English is not your first language, this course offers vocabulary, grammar and legal concepts that can help with your SQE studies.
